In response to 2003 and 2004 FOIA requests, the ACLU received and publicized documents in which FBI personnel expressed concerns about the interrogation methods being used in Iraq, Afghanistan, and Guantanamo. The DOJ Inspector General then investigated the FBI’s involvement in those interrogations. When the IG’s report was completed but not released, we filed a FOIA request in April 2008, seeking the IG report and related records. A redacted version of the report was released in May 2008, which discussed concerns raised by FBI agents about interrogation methods that had been used by DOD and CIA personnel; the response of FBI headquarters to the concerns raised by FBI agents; and the response of the DOD, CIA, and other agencies to concerns raised by FBI headquarters and the DOJ. The following month we filed suit seeking release of the full report and its underlying documents.
After several years of foot-dragging by the government, by April 2012 we received some of the documents we had requested. We decided not to challenge DOJ’s decision to withhold the remaining documents, and so we voluntarily dismissed the lawsuit.
